These Terms of Use (the “Terms”) govern your access to and use of https://baloch.net and the accounts, member profiles, contribution tools, cultural archives, galleries, Balochi Batal features, sharing tools, and other services made available through Baloch.Net (collectively, the “Services”).

The Services are operated by Baloch.Net (“Baloch.Net”, “we”, “us”, or “our”). By accessing or using the Services, creating an account, or submitting content, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Purpose of Baloch.Net

Baloch.Net is a cultural and community platform intended to connect Baloch people, preserve cultural memory, and provide access to community-contributed stories, articles, photographs, galleries, oral histories, places, member profiles, Balochi Batals (proverbs), translations, and related heritage material.

Baloch.Net is an independent community platform. Unless expressly stated otherwise, it does not represent any government, political party, tribe, religious body, commercial organization, or every Baloch individual or community.

2. Eligibility

You must be at least 13 years old to create an account or submit personal information. If the law where you live requires a higher age to enter into these Terms or consent to online data processing, you may use the Services only if a parent or legal guardian has authorized your use.

By using the Services, you confirm that you have the legal capacity to accept these Terms and are not prohibited by applicable law from using the Services.

3. Accounts and security

You must provide accurate, current, and complete account information.
You may not impersonate another person or falsely claim an identity, role, affiliation, location, or community status.
You are responsible for maintaining the confidentiality of your password and account credentials.
You are responsible for activity performed through your account unless you promptly report unauthorized access.
You must notify us at support@baloch.net if you believe your account has been compromised.
You may not sell, transfer, lend, or share an account in a manner that compromises its security or misrepresents the user.

If you use Google sign-in, your use of Google’s service is also governed by Google’s applicable terms and policies. Baloch.Net does not receive or store your Google password.

4. Member profiles and public information

Member profiles may include a name, approved photograph, profession, biography, city, country, tribe, website, and other information selected by the member. You control certain public-display options through the Profile & privacy settings.

Public profiles and profile photographs may be reviewed before publication. Approval means only that the material has passed our moderation process; it is not an endorsement, identity verification, professional certification, or guarantee that every statement is accurate.

You must not publish private addresses, identification numbers, financial information, passwords, or other highly sensitive information in your profile.

5. Contributions

Registered users and guests may be able to submit stories, articles, photographs, ideas, translations, Balochi Batals, descriptions, cultural context, sources, gallery material, and other content (“Contributions”).

Contributions are normally reviewed before publication and may remain pending, be edited, approved, rejected, unpublished, or removed.

When submitting a Contribution, you represent and warrant that:

you created it, own the necessary rights, or have permission to submit and license it;
it does not infringe copyright, trademark, privacy, publicity, confidentiality, contractual, or other rights;
you have permission from identifiable people shown, quoted, or discussed where permission is legally or ethically required;
information presented as fact is, to the best of your knowledge, accurate and not deliberately misleading;
sources, authors, photographers, translators, and community origins are credited where known and appropriate;
the Contribution does not contain malicious code, hidden advertising, spam, or unlawful material; and
your submission complies with these Terms and applicable law.

6. Your ownership and the licence you grant

You retain any copyright and other rights you lawfully hold in your Contributions. Submitting content does not transfer ownership to Baloch.Net.

However, by submitting a Contribution, you grant Baloch.Net a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to host, store, reproduce, preserve, archive, format, edit, adapt, translate, publish, display, distribute, communicate, promote, index, and make the Contribution available through the Services and Baloch.Net’s official communications and social-media channels.

This licence allows us to perform ordinary editorial work, including correcting spelling, improving formatting, creating excerpts or thumbnails, resizing photographs, adding captions, categorizing material, preparing translations, generating social-share cards, and migrating content to new technical formats.

We will seek to preserve the intended cultural meaning and provide reasonable attribution when authorship is known.

The licence continues for as long as the Contribution is published or reasonably retained in our archive, backups, editorial records, or materials already distributed.

If you request removal, we will consider the request in light of your rights, the rights of others, applicable law, attribution, public interest, cultural preservation, and archival integrity. Removal from Baloch.Net cannot recall copies already downloaded, shared, indexed, cached, or republished by others.

7. Traditional and community knowledge

Some Batals, oral histories, expressions, designs, customs, and cultural materials may have no single identifiable author and may belong to a longstanding community tradition.

Publication by Baloch.Net does not claim private ownership over traditional knowledge or material that is lawfully in the public domain.

Contributors should identify known sources, regions, dialects, communities, collectors, photographers, translators, and custodians.

If you believe cultural material is incorrectly attributed, mistranslated, culturally sensitive, or should not be public, contact us so the editorial team can review it.

8. Photographs and media

You may upload photographs or media only when you have the necessary rights and permissions.

Extra care must be taken with children, private events, sacred or restricted locations, funerals, medical situations, vulnerable people, and culturally sensitive ceremonies or objects.

We may request proof of authorship or permission, limit identifying details, reject a submission, or remove media where privacy, safety, copyright, dignity, or cultural concerns outweigh the value of publication.

9. Prohibited conduct and content

You must not use the Services to:

break any applicable law or encourage unlawful activity;
harass, threaten, stalk, intimidate, exploit, or deliberately humiliate another person;
publish hate speech or content that unlawfully promotes violence or discrimination;
publish sexual exploitation material or any sexual content involving minors;
reveal another person’s private or sensitive information without lawful justification;
impersonate another person or misrepresent authorship, qualifications, affiliation, or authority;
submit defamatory, fraudulent, deliberately false, deceptive, or manipulated material;
infringe intellectual-property, privacy, publicity, confidentiality, or contractual rights;
upload malware, harmful code, corrupted files, or material intended to compromise security;
send spam, unauthorized promotions, scams, pyramid schemes, or repetitive submissions;
scrape, harvest, copy, or extract personal information or substantial website content through unauthorized automated means;
probe, bypass, disable, overload, or interfere with authentication, rate limits, moderation, security, or network protections;
access another person’s account or restricted administrative areas without authorization;
use content or member information to train facial-recognition systems, build unlawful surveillance tools, or target vulnerable persons; or
use the Services in a way that creates unreasonable risk, liability, disruption, or harm.

10. Moderation and editorial discretion

Baloch.Net may, but is not obligated to, review submissions and activity. To the extent permitted by law, we may edit, label, limit, reject, unpublish, remove, preserve, or restore content; request supporting information; restrict features; or suspend or terminate accounts.

Moderation decisions may consider relevance, quality, accuracy, duplication, attribution, copyright, privacy, safety, cultural sensitivity, available resources, and the objectives of Baloch.Net.

Publication is not guaranteed, and we are not required to publish every viewpoint, submission, response, or correction request.

11. Sharing and downloadable content

The Services may allow users to download or share public content through WhatsApp, Facebook, X, native device sharing, or other services.

When using these features, you are responsible for the recipients you select and for complying with the receiving platform’s terms and applicable law.

Baloch.Net share cards, branding, signatures, source links, and attribution must not be removed or altered in a misleading way.

Sharing a public page does not grant permission to commercially exploit its content or falsely claim authorship.

12. Baloch.Net content and intellectual property

Except for user Contributions, traditional material, third-party content, and public-domain material, the Services and their original design, code, organization, graphics, logos, branding, editorial compilations, and other materials are owned by or licensed to Baloch.Net and are protected by applicable intellectual-property laws.

We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Services for lawful personal, cultural, educational, and community purposes in accordance with these Terms. No other rights are granted by implication.

13. Copyright and rights complaints

If you believe material on Baloch.Net infringes your copyright or another legal right, email legal@baloch.net with:

your full name and contact information;
identification of the protected work or right;
the exact Baloch.Net URL and a description of the disputed material;
an explanation of your ownership, authority, or relationship to the affected person or community;
the action you request;
a good-faith statement that the disputed use is unauthorized or unlawful; and
a statement that the information in your notice is accurate.

We may request further evidence, notify the contributor, temporarily restrict access, correct attribution, or remove material while reviewing a complaint.

Knowingly submitting a false or misleading complaint may result in legal responsibility.

14. Third-party links and services

Baloch.Net may link to member websites, sources, maps, social networks, messaging platforms, Google sign-in, and other third-party services.

We do not control and are not responsible for third-party content, availability, security, terms, products, or privacy practices. A link does not necessarily mean that Baloch.Net endorses the third party.

15. Community interactions and member information

Exercise care when contacting or meeting people discovered through Baloch.Net. We do not guarantee a member’s identity, background, qualifications, location, intentions, or statements.

You are responsible for your interactions and should not send money, passwords, identification documents, or other sensitive information to someone merely because they appear in the member directory.

16. No professional advice

Content on Baloch.Net is provided for cultural, historical, educational, and general information purposes.

It is not legal, medical, financial, security, political, or other professional advice.

Historical accounts, translations, locations, traditions, and community submissions may be incomplete, disputed, approximate, or affected by different dialects and perspectives.

17. Service availability and changes

We may modify, update, suspend, restrict, or discontinue any part of the Services at any time.

We do not guarantee uninterrupted operation, permanent availability of any feature or content, or compatibility with every browser or device.

Maintenance, security incidents, hosting issues, legal requirements, or events outside our control may interrupt access.

18. Disclaimers

To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis.

Baloch.Net disclaims all express and implied warranties, including warranties of accuracy, completeness, authenticity, reliability, merchantability, fitness for a particular purpose, non-infringement, availability, and security.

We do not guarantee that user content is accurate, that every submitted item has been independently verified, that defects will be corrected, or that the Services will always be free from harmful components.

Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

19. Limitation of liability

To the fullest extent permitted by law, Baloch.Net and its operators, administrators, editors, volunteers, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, reputation, opportunity, revenue, profits, goodwill, or use arising from or related to the Services.

To the fullest extent permitted by law, the total aggregate liability of Baloch.Net for all claims relating to the Services will not exceed the greater of the amount you paid directly to Baloch.Net for the Services during the twelve months before the claim or US $100.

These limitations do not apply where liability cannot legally be limited or excluded, including where applicable for fraud, wilful misconduct, or death or personal injury caused by negligence.

20. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Baloch.Net and its operators, administrators, editors, volunteers, contractors, and service providers from claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from your unlawful use of the Services, your Contributions, your breach of these Terms, or your violation of another person’s rights.

21. Suspension, termination, and account deletion

You may stop using the Services at any time and may request account deletion through your account settings.

We may warn, restrict, suspend, or terminate access when we reasonably believe you have violated these Terms, created risk or legal exposure, abused the Services, or threatened users, cultural material, or platform security.

Provisions that by their nature should survive termination will survive, including provisions concerning content licences, archival copies, intellectual property, disclaimers, liability, indemnity, disputes, and general legal terms.

22. Governing law and disputes

These Terms and any dispute arising from them or the Services are governed by the applicable laws of Pakistan, without regard to conflict-of-law principles.

Subject to any mandatory rights or procedures under applicable law, disputes will be submitted to the courts of competent jurisdiction in Pakistan.

Before filing a formal claim, you agree to contact us and make a good-faith attempt to resolve the dispute informally.

Nothing in this section prevents either party from seeking urgent protective or injunctive relief where legally available.

23. Changes to these Terms

We may update these Terms to reflect changes to the Services, community standards, technology, or legal requirements.

We will publish the revised Terms and change the “Last updated” date. Where changes are material, we may provide additional notice through the website, account interface, or email.

Continued use after revised Terms take effect constitutes acceptance to the extent permitted by law.

24. General provisions

Entire agreement: These Terms and the Privacy Policy form the agreement between you and Baloch.Net concerning the Services.
Severability: If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue.
No waiver: A failure to enforce a provision is not a waiver of the right to enforce it later.
Assignment: You may not assign your rights or obligations under these Terms without our consent. We may assign these Terms as part of an organizational restructuring or transfer of the Services.
No partnership: These Terms do not create employment, agency, partnership, joint venture, fiduciary, or franchise relationships.
Headings: Section headings are for convenience and do not affect interpretation.
